Terms of Use

These Terms of Use ("Terms") govern your access to and use of swaram.live — the real-time Malayalam voice API and developer dashboard (the "Service") operated by Pattern AI Labs, a trading name of Nexbillion Labs Private Limited ("Pattern AI Labs", "we", "us", or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

swaram.live provides a real-time Malayalam voice interface accessed over an API. The Service is provided on an "as is" and "as available" basis. We may add, change, or remove features over time.

Accounts

You access the Service through an account created with a supported sign-in provider. You agree to provide accurate information, to keep your credentials and API keys secure, and to be responsible for all activity under your account. Notify us promptly at info@pattern-ai.com of any unauthorised use.

Acceptable use

You agree not to use the Service to:

• break any applicable law or regulation, or infringe anyone's rights;
• transmit unlawful, harmful, deceptive, or abusive content;
• impersonate others or transmit a person's voice without the consent required by law;
• attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service or its infrastructure; or
• resell or expose the Service in a way that competes with us, except as expressly permitted.

We may apply rate limits and other technical controls, and we may suspend access that we reasonably believe violates these Terms or threatens the Service.

Your content and data

You retain ownership of the instructions, context, and content you send to the Service ("Customer Content"). You grant us the limited right to process Customer Content solely to provide the Service to you. You are responsible for your Customer Content, for having the rights and consents needed to send it (including consent of any individuals whose voices you transmit), and for your end users' use of your application.

How we handle data, including the fact that we do not store voice audio, is described in our Privacy Policy.

Credits, billing, and payments

The Service is billed using credits and/or subscription plans as shown in your dashboard. Payments are processed by our third-party payment provider acting as merchant of record. Charges are due according to the plan you select. Except where required by law, payments are non-refundable. We may change pricing and plans on a prospective basis, with notice through the Service.

Intellectual property

The Service, including its software, models, designs, and content (excluding Customer Content), is owned by Pattern AI Labs and its licensors and is protected by applicable laws. These Terms do not grant you any rights in the Service except the limited right to use it as permitted here.

Availability

We aim to keep the Service available and performant but do not currently guarantee any particular uptime or response time. We may perform maintenance, and the Service may be temporarily unavailable.

Disclaimers

To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. You are responsible for evaluating whether the Service is suitable for your use.

Limitation of liability

To the maximum extent permitted by law, Pattern AI Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Pattern AI Labs from claims arising out of your Customer Content, your use of the Service, or your breach of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of India, and the courts of Kerala, India will have exclusive jurisdiction over any dispute, subject to applicable law.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and significant changes may be communicated through the Service. Your continued use of the Service after changes take effect constitutes acceptance.
